Campus Containers LLC
These Terms and Conditions (the "Terms") constitute a legal agreement between the customer ("Customer," "you," or "your") and Campus Containers LLC ("Campus Containers," "Company," "we," "us," or "our") governing Customer's use of Campus Containers' storage, shipping, and moving services (the "Services"). By creating an account, submitting a reservation, or otherwise using the Services, Customer agrees to be bound by these Terms. Customers who do not agree to these Terms should not use the Services.

1. Acceptance of Terms
Customer's creation of an account, submission of a reservation, or use of any Service constitutes Customer's acknowledgment that Customer has read, understood, and agreed to be bound by these Terms, as they may be amended from time to time in accordance with Section 24.

2. Definitions

"Order" means any reservation submitted by Customer for storage, shipping, or related add-on services.

"Item" means any individual box, bin, bag, or other item of personal property stored or shipped by Customer through the Services.

"Storage Period" means the applicable season or fixed duration associated with an Order, as further described in Section 5.

"VIP Package" means the optional upgraded membership described in Section 7.

3. Eligibility and Account Registration
Customer represents and warrants that Customer is at least eighteen (18) years of age. Customer agrees to provide accurate, current, and complete information in connection with account registration and to promptly update such information as necessary. Customer is solely responsible for maintaining the confidentiality of Customer's account credentials and for all activity occurring under Customer's account, whether or not authorized by Customer.

4. Service Model
Campus Containers directly performs the pickup, storage, and delivery of Items and does not delegate these core functions to unaffiliated third-party moving companies.
For the security of stored property, Campus Containers does not disclose the physical location of its storage facilities to Customers. All Campus Containers storage facilities are climate-controlled.
Campus Containers is not affiliated with, sponsored by, or endorsed by any college, university, fraternity, sorority, or student housing organization. References to particular institutions on Campus Containers' website or marketing materials are provided solely to facilitate scheduling and do not imply any relationship with such institutions.

5. Storage Periods and Pricing
Campus Containers offers the following Storage Periods:

Summer Storage — four (4) months
-
Fall Storage — four (4) months
-
Winter Storage — four (4) months
-
Spring Storage — four (4) months
-
Ship Home 2 School — four (4) months
-
Seasonal Storage (full academic year) — ten (10) months
Fees for the applicable Storage Period are due in full at the time of booking. Because Campus Containers allocates capacity and schedules pickup and delivery resources in advance of each Storage Period, fees are non-prorated in the event a Storage Period commences later, or concludes earlier, than the applicable scheduled dates. A Customer requiring storage beyond the applicable Storage Period should contact Campus Containers prior to its conclusion to arrange an extension.
The standard service radius for pickup and delivery is four (4) miles from Customer's designated pickup campus. Certain campuses are subject to a different service radius or delivery terms, which, where applicable, will be disclosed on the relevant campus page prior to booking.

6. Scheduling, Rescheduling, and Cancellation
6.1 Rescheduling to a Standard Date
A rescheduling fee of $80.00 applies where Customer elects to move a scheduled pickup or delivery to another standard (non-VIP) date.
6.2 Non-Standard or Special Date Requests
A fee of $200.00 applies to any request for a pickup or delivery date outside Campus Containers' standard scheduling windows. This fee is waived for Customers enrolled in the VIP Package.
6.3 Missed Appointments
Where Customer, or an alternate designated by Customer, is not present for a scheduled pickup or delivery, a fee of $90.00 applies. Customer may designate an alternate in advance to receive Items on Customer's behalf.
6.4 Cancellation and Refunds

Reservation fees are non-refundable under all circumstances.

Item and storage fees are fully refundable where Customer cancels at least three (3) days prior to the scheduled pickup date.

Item and storage fees are refundable at a rate of fifty percent (50%) where Customer cancels less than forty-eight (48) hours prior to the scheduled pickup date.

VIP Package fees are fully refundable for a period of ninety (90) days following purchase, provided that no VIP Package benefit has been used during such period.

Notwithstanding the foregoing, any refund owed to Customer pursuant to this Section 6.4 is contingent upon, and will not be issued until, Customer has returned all Campus Containers bins allocated to Customer's Order during the standard scheduled pickup times applicable to Customer's campus.
6.5 Company-Initiated Scheduling Changes
Campus Containers reserves the right to modify a scheduled pickup or delivery date or time where necessitated by severe weather, safety considerations, or other circumstances beyond Campus Containers' reasonable control. Campus Containers will use commercially reasonable efforts to notify Customer in advance of any such modification.

7. VIP Package
Campus Containers offers an optional VIP Package providing the following benefits:
The VIP Package is an annual status that runs from July through June of the current academic year.

Waiver of the $200.00 fee applicable to non-standard or special date requests;

Waiver of the standard reservation fee; and
-
Full refund of the VIP Package fee upon request within ninety (90) days of purchase, provided no VIP Package benefit has been used.
Upon Customer's use of any VIP Package benefit, the VIP Package fee becomes non-refundable.

8. Payment Terms
8.1 Reservation Fee
A non-refundable reservation fee, separate and distinct from applicable storage or shipping fees, is required to book Services. This fee is waived for Customers enrolled in the VIP Package.
8.2 Accepted Payment Methods
Campus Containers accepts payment by credit or debit card only; cash and checks are not accepted. By submitting an Order, Customer authorizes Campus Containers to automatically charge Customer's card on file for all fees described in these Terms, including without limitation storage fees, add-on fees, and any fees set forth in Section 16.
8.3 Timing of Charges
Standard fees are charged to Customer's card on file at the time an Order is placed. Additional fees, including without limitation those arising from rescheduling, missed appointments, or improperly packed Items, are charged as incurred.
8.4 Modification or Revocation of Payment Authorization
Customer may update Customer's payment method at any time through Customer's account. Customer's revocation of auto-charge authorization must be submitted to Campus Containers in writing. Such authorization, and any obligation to pay outstanding amounts owed, remains in effect until Campus Containers confirms receipt of Customer's written revocation.

9. Restricted and Prohibited Items
The following items may not be stored or shipped through the Services:

Cash, furs, jewelry, and other high-value collectibles;
-
Hazardous, flammable, combustible, or otherwise dangerous materials; and
-
Perishable or unrefrigerated food items.
Campus Containers reserves the right to decline pickup of any Item that violates this Section 9 or that is not adequately packed for safe storage or transport.

10. Packing Responsibility
Customer is solely responsible for properly packing, boxing, and labeling all Items prior to pickup. In the event an Item is not adequately packed or boxed for safe storage or transport, Campus Containers may place the Item in an appropriately sized Campus Containers bin, and Customer will be charged the standard rate applicable to that bin size.

11. Insurance and Damage Coverage
11.1 Automatic Coverage
Each Order includes automatic coverage of $100.00 per Order (not per Item) against loss of, or damage to, Items occurring while in Campus Containers' custody.
11.2 Optional Coverage Upgrades
Customer may elect to purchase additional coverage at checkout as follows:

$19.99 for coverage of up to $1,000.00 per Order;
-
$39.99 for coverage of up to $2,000.00 per Order; or
-
$59.99 for coverage of up to $3,000.00 per Order.
11.3 Coverage Is Secondary
Coverage provided by Campus Containers is secondary to any applicable homeowner's, renter's, or other personal insurance policy maintained by Customer. Customer must first submit a claim to Customer's own insurance provider; Campus Containers' payout, if any, applies only to amounts not covered by Customer's personal policy.
11.4 Exclusions
The coverage described in this Section 11 does not apply to loss or damage involving:

Unpackaged or uncrated furniture;
-
Cash, furs, jewelry, and collectibles;
-
Fragile items;
-
Electronics not stored in original manufacturer packaging;
-
Particle-board or ready-to-assemble furniture;
-
Damage attributable to natural disasters or other events beyond Campus Containers' reasonable control;
-
Concealed or internal damage absent visible exterior damage;
-
Hazardous materials; and
-
Items exceeding fifty (50) pounds.

12. Claims Process
Customer must report any loss or damage to Campus Containers within twenty-four (24) hours of delivery and submit a completed claim within three (3) days of delivery. Claims submitted after this period may be denied. A completed claim must include: (a) photographs of the affected Item(s) and packaging; (b) a written description of the loss or damage; (c) the value declared for the Item at the time of booking; (d) tracking information, where the Item was shipped by a third-party carrier; and (e) proof of purchase, for claims of $300.00 or more. Campus Containers will respond to completed claims within thirty (30) days of submission.

13. Shipping — Ship Home 2 School
Items shipped through the Ship Home 2 School service are transported by a third-party carrier and, once in such carrier's custody, are subject to the carrier's own claims and liability policies. Campus Containers disclaims all liability for loss or damage occurring while an Item is in the custody of a third-party carrier; any such claim must be submitted directly to the carrier.

14. Abandoned Property
Where Customer fails to appear for a scheduled delivery and has not made alternate arrangements, Customer's Items may be deemed abandoned. Campus Containers will attempt to contact Customer using the information on file, up to four (4) times. If Campus Containers is unable to reach Customer or arrange delivery within thirty (30) days of the missed delivery date, Campus Containers reserves the right to dispose of the applicable Items in its sole discretion, including by donation, sale, or disposal, without further notice or compensation to Customer.

15. Bin Rental Agreement
Campus Containers bins remain the property of Campus Containers at all times and are provided to Customer on a rental basis for use in connection with an Order. By accepting delivery of one or more bins, Customer agrees to the following terms governing their use and return.
15.1 Return Windows

Where bins are provided in connection with a scheduled pickup, Customer must return all bins within forty-eight (48) hours of the scheduled pickup time.
-
Where bins are provided in connection with a delivery, Customer must return all bins on the same day as delivery.
15.2 Unreturned or Damaged Bins
Customer will be charged a fee of $50.00 per bin for any bin that is not returned within the applicable return window set forth in Section 15.1, or that is returned in a functionally damaged condition. Customer authorizes Campus Containers to charge such fee to Customer's card on file in accordance with Section 8.

16. Fee Schedule Summary
The following table summarizes certain fees referenced above and is provided for Customer's convenience. In the event of any conflict, the description of the applicable fee set forth in the corresponding section above will govern.

17. University Affiliation Disclaimer
Campus Containers LLC is an independent company and is not affiliated with, sponsored by, endorsed by, or acting on behalf of any college, university, fraternity, sorority, or student housing organization. Any institutional names, logos, or references appearing on Campus Containers' website or marketing materials are used solely for descriptive and scheduling purposes.

18. Disclaimer of Warranties
EXCEPT AS EXPRESSLY SET FORTH IN THESE TERMS, THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

19. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CAMPUS CONTAINERS' TOTAL LIABILITY TO CUSTOMER ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE AMOUNT OF COVERAGE APPLICABLE TO CUSTOMER'S ORDER UNDER SECTION 11. IN NO EVENT SHALL CAMPUS CONTAINERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Any claim arising out of or relating to these Terms or the Services must be brought within three (3) months of the date such claim accrued, or such claim shall be permanently barred to the fullest extent permitted by applicable law.

20. Indemnification
Customer agrees to defend, indemnify, and hold harmless Campus Containers LLC and its officers, employees, contractors, and agents from and against any and all claims, damages, losses, liabilities, and expenses, including reasonable attorneys' fees, arising out of or relating to: (a) Customer's breach of these Terms; (b) Customer's violation of any applicable law or the rights of any third party; (c) any Item that causes injury, death, or property damage; or (d) Customer's use of the Services.

21. Dispute Resolution; Binding Arbitration; Class Action Waiver
PLEASE READ THIS SECTION CAREFULLY, AS IT AFFECTS CUSTOMER'S LEGAL RIGHTS.
21.1 Agreement to Arbitrate
Customer and Campus Containers agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Services shall be resolved through binding, individual arbitration rather than in court, provided that either party may bring an individual claim in small claims court where jurisdictionally appropriate.
21.2 Class Action Waiver
CUSTOMER AND CAMPUS CONTAINERS AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.
21.3 Jury Trial Waiver
CUSTOMER AND CAMPUS CONTAINERS EACH WAIVE ANY RIGHT TO A TRIAL BY JURY IN CONNECTION WITH ANY DISPUTE ARISING OUT OF OR RELATING TO THESE TERMS.

22. Governing Law and Venue
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws principles. Subject to Section 21, Customer agrees that any action not subject to arbitration shall be brought exclusively in the state or federal courts located in Dallas County, Texas, and Customer consents to the personal jurisdiction of such courts.

23. Communications Consent
By providing an email address and telephone number, Customer consents to receive transactional communications from Campus Containers — including order confirmations, scheduling updates, and payment notices — via email and SMS. Where Customer opts in, Customer may also receive marketing communications; message and data rates may apply, and message frequency may vary. Customer may opt out of marketing communications at any time by replying "STOP" or following the unsubscribe instructions provided in any marketing communication. Transactional communications will continue notwithstanding Customer's marketing opt-out status.

24. General Provisions
24.1 Entire Agreement
These Terms constitute the entire agreement between Customer and Campus Containers with respect to the Services and supersede any prior or contemporaneous agreements or understandings, whether written or oral.
24.2 Severability
If any provision of these Terms is held to be invalid or unenforceable, such provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
24.3 Amendments
Campus Containers reserves the right to amend these Terms from time to time. Customer's continued use of the Services following any such amendment constitutes Customer's acceptance of the amended Terms.
24.4 Assignment
Customer may not assign or transfer these Terms, whether by operation of law or otherwise, without Campus Containers' prior written consent. Campus Containers may assign these Terms without restriction in connection with a merger, acquisition, or sale of assets.
